By contracting for Real Estate Photography services through Nemec Photography, you (as the agent/client), agree that all photos and rights relating to them, including copyright and ownership rights in the media in which the photos are stored, remain the sole and exclusive property of the photographer as protected by the Copyright Act 17 U.S.C § 106. Nemec Photography chooses to grant Reproduction Rights to you, the client, in exchange for these services. This includes the limited right to reproduce, publicly display, and distribute the photos only for promotional or advertising purposes directly related to the sale of the property, including through any MLS listing service. Photos used for any purpose not directly related to the sale of the Property must be with the express permission of Photographer and the payment of additional fees, unless otherwise agreed to in writing. Photography will take place only upon receipt of payment. Inclement weather conditions are out of the photographer’s control. Reasonable efforts will be made to reschedule should weather cause a session to be cancelled. Agent/Client is responsible for ensuring the property is ready prior to photographer arrival. Trip fee will be accessed for any scheduled session where photographer arrives at property and is unable to produce quality images due to property condition.

Drone Agreement in addition to the above: Client acknowledges mission is flown in accordance to all FAA regulations under 14 CFR Part 107 rules as it pertains to Commercial sUAS Licensing. All flights will be insured by Verifly. Drone package prices will change based on location insurance premiums. Photographer/Person in Control (PIC) has final authority over operations and can terminate flight activity at any time if it is deemed not safe. This can include but is not limited to the following conditions that are present at the time of flight or develop during flight: weather; available natural light; innocent third party safety and/or health risk; discovered FAA restrictions immediately prior to or during flight; developed risk prior to or during flight to crew members; or any reason the Photographer/PIC deems necessary to terminate flight due to safety of all parties involved directly and indirectly.
